DISCLAIMER AND LIMITATION OF LIABILITY

California Seed & Plant Lab., Inc (CSP Labs) offers testing services to its clients with following terms, disclaimers and limitations of liability.

Payment for Services

Payment for services provided by CSP Labs is due upon receipt of the invoice. Service charges of 1.5% per month may be applied to invoice statements over 30 days past due. Fees for services are subject to change without notice.

General Disclaimer

Any analysis performed by CSP Labs upon seed submitted to CSP Labs is based entirely upon the sample received. The representative nature of the sample is the responsibility of the client. CSP Labs warrants that the analysis performed by CSP Labs will be conducted according to CSP Labs laboratory protocols, however CSP Labs analysis does not represent a guarantee of seed quality, freedom from disease, or genetic quality of the lot from which the sample was taken. The client will advise CSP Labs of any seed treatments applied to the seed and any other facts or circumstances that may influence CSP Labs analysis. CSP Labs will attempt to keep confidential the client’s proprietary information and test results, except when disclosure is required by law or court order. Except as stated above, CSP Labs makes no representation or warranty, express or implied, for its services. CSP Labs and the client acknowledge this is a commercial transaction and that CSP Labs will not be liable to the client, or any other person, for incidental or consequential damages. The client further acknowledges that its exclusive and sole remedy for any loss as a result of any services performed by CSP Labs is limited to the amount paid to CSP Labs by the client for the services performed.

BFB Disclaimer

CSP Labs offers certain test procedures for the detection of seed borne Acidovorax citrulli (BFB) in cucurbit seed. These test procedures will not guarantee that seed is free from BFB. CSP Labs makes no representation or warranty, express or implied, that any seed lot tested using any test procedure is free from BFB. Should the client release any seed lot in reliance upon BFB testing performed by CSP Labs, the client assumes all risks associated therewith and agrees to indemnify and hold harmless CSP Labs against any and all claims, actions, or proceedings resulting therefrom. CSP Labs general disclaimer set forth above is incorporated herein and client agrees that the exclusive and sole remedy against CSP Labs is for the amount paid for the test procedures.

UltraDirect PCR

In this technique, bacterial extract from seeds is tested by PCR. The success of this test depends upon the extraction of pathogens from the seeds into the liquid and specificity of the primers. Although, we have been using the method successfully, there is a potential possibility of obtaining false negatives (due to inefficient extraction of bacteria from certain internally-infected seed lots and failure of primers to react with certain strains of the pathogen) and false positives (due to cross reaction of primers with certain strains of the non-pathogens). Due to these biological uncertainties, we do not offer any warranty, what so ever, for conducting ultraDirect PCR procedure on your samples. We will not be responsible for any damages that you may incur from selling seeds that have been tested by our ultraDirect PCR.

Bio-PCR

In this technique, bacterial extract from seeds is plated onto selective media and the bacterial harvest from plates is tested by PCR. The success of this test depends upon the extraction of pathogens from the seeds into the liquid, ability of the pathogen to grow on selective media and specificity of the primers. Although, we have been using the method successfully, there is a potential possibility of obtaining false negatives (due to inefficient extraction of bacteria from certain internally-infected seed lots, inability of certain strains to grow on selective media and failure of primers to react with certain strains of the pathogen) and false positives (due to cross reaction of primers with certain strains of the non-pathogens). Due to these biological uncertainties, we do not offer any warranty, what so ever, for conducting Bio-PCR procedure on your samples. We will not be responsible for any damages that you may incur from selling seeds that have been tested by our Bio-PCR method.

Seedling PCR

In this technique, seedlings are grown under controlled conditions and bacterial extract from seedlings is tested by PCR. The success of this test depends upon successful transmission of bacteria from seeds to seedlings and specificity of the primers. Although, we have been using the method successfully, there is a potential possibility of obtaining false negatives (due to inefficient transmission of pathogen from seeds to seedlings from certain seed lots, and failure of primers to react with certain strains of the pathogen) and false positives (due to cross reaction of primers with certain strains of the non-pathogens). Due to these biological uncertainties, we do not offer any warranty, what so ever, for conducting Seedling PCR procedure on your samples. We will not be responsible for any damages that you may incur from selling seeds that have been tested by our Seedling PCR method.

Liquid plating

In this technique, bacterial extract from seeds is dilution plated onto selective media and suspect colonies tested to identify pathogen. The success of this test depends upon successful extraction of the pathogen into liquid and selectivity of the media. Although, we have been using the method successfully, there is a potential possibility of obtaining false negatives (due to due to inefficient extraction of bacteria from certain internally-infected seed lots, inability of certain strains to grow on selective media and interference in plate reading by other bacteria) and false positives by ability of other bacteria to cause border-line symptoms in the pathogenicity tests. Due to these biological uncertainties, we do not offer any warranty, what so ever, for conducting Liquid plating procedure on your samples. We will not be responsible for any damages that you may incur from selling seeds that have been tested by our Liquid plating method.
